Former Congress chief minister of Delhi Sheila Dikshit has been appointed as the Governor of Kerala.
Yes, that qualifies for being called God’s grace.
With Congress and RJD alliance coming in place, RJD chief Lalu Prasad Yadav was seen coming out of serving Kerala Governor Nikhil Kumar’s home in Patna. Rumours were that Kumar will fight for Aurangabad seat which is called “Chittorgarh of Bihar” for its Rajput population.
The rumours were confirmed when Congress and RJD announced that Prasad had gone to seek blessings of Kumar’s mother Kishori Sinha. Kumar, who was once police commissioner of Delhi, is son of veteran Congress leader and former Bihar chief minister Satyanarayan Singh.
Within hours of this meeting, Kumar, who was travelling from Kochi to Delhi, faxed his resignation to President Pranab Mukherjee from airport. In the wee hours of night, Dikshit was appointed as the Governor of the state.
Now why was Congress in such a hurry on the eve of Election Commission’s announcement of the poll schedule for the Lok Sabha election?
Congress party’s decision of taking ordinance route to many pending bills was already stalled by Mukherjee who refused to be a mere rubberstamp. With Rahul Gandhi’s much hyped “anti-corruption mechanism” ordinances falling flat, Congress couldn’t get anything in its goodwill basket. Then why this hurried decision before model code of conduct coming into place?
It should be noted that former Delhi chief minister and AAP leader Arvind Kejriwal had ordered a probe in the Commonwealth Games scam targeting Dikshit. Shortly before Arvind Kejriwal resigned as Delhi chief minister, he moved the high court on behalf of the government, asking to take back the appeal filed by the then Congress government headed by Dikshit. The Kejriwal government’s argument was that Dikshit would have to defend herself as she was no more the CM and the government lacked the locus standi to fight for her.

Now, as Article 361(2) in of the Constitution states: “no criminal proceedings whatsoever shall be instituted or continued against the President or the Governor of a State, in any court during his term of office”. Therefore, being a Governor, she will have a constitutional shield against criminal cases that might be registered against her in due course, following investigations in the Commonwealth Games scam and irregularities in the Delhi Technological University admissions.
The game will only change if the next government formed at the centre is a non-Congress one and decides to remove her from the post.
